1. Using Bestcoverartists

In connection with using or accessing our platform you agree to comply with this user agreement, our policies, our terms, and all applicable laws, rules, and regulations, and you agree to not:

• upload, post, or list content or items to our platform in the inappropriate content that is pornographic, discriminating, or offensive;
• violate or circumvent any applicable laws, regulations, or third-party rights, as well as our systems, services, policies, or account status determinations;
• fail to deliver products that you have sold;
• manipulate the price of any product or disrupt with the listings of other users;
• post harmful or libelous content that is misleading or inaccurate;
• distribute or post spam, unsolicited or chain letters, or pyramid schemes;
• distribute viruses or any other technologies that may damage bestcoverartists.com or property of users;
• interfere with the performance of our services, such as by placing an abnormally large or unreasonable load on our infrastructure;
• export or re-export any Bestcoverartists application or tool, except in compliance with the export control laws, and rules and policies of any relevant jurisdictions;
• infringe the copyright, trademark, patent, publicity, moral, database, and/or other intellectual property rights that belong to or are licensed to bestcoverartists.com. Some, but not all, actions that may constitute infringement are reproducing, performing, displaying, distributing, copying, reverse engineering, decompiling, disassembling, or preparing derivative works from content that belongs to Bestcoverartists or someone else;
• infringe on any intellectual property rights of third parties whose rights are affected by your use of our platform, or upload content that is not yours;
• commercialize any Bestcoverartists application, or any information or software linked with such an application, unless Bestcoverartists has given you prior written consent;

bypass any public safety agencies in place to ensure the quality of our services.

2. Choice of law

Except as otherwise specified in this agreement, you agree that the laws of the Netherlands, without regard to principles of conflict of laws, shall govern this user agreement and any claim or disagreement that has arisen or may arise between you and Bestcoverartists.

3. Transactions between buyers and sellers

Bestcoverartists offers a digital web-based platform for product and service buyers and sellers to exchange information and /or products. Bestcoverartists additionally provides a digital web-based transaction platform for members to place, accept, conclude, manage and fulfill orders for the provision of products and services online within the sites subject to the terms of the transaction services agreement. Bestcoverartists does not represent either the seller or the buyer in specific transactions for any services. Bestcoverartists does not control and is not accountable or responsible for the quality, safety, lawfulness or availability of the items or services listed for sale on the platform, the ability of the sellers to complete a transaction or the capacity of buyers to make a purchase.

4. Fees

We have the ability to adjust our selling fees at any moment by posting the changes fourteen (14) days in advance on bestcoverartists.com.

If you are a seller, you are liable for transaction costs arising out of all sales made utilizing some or all of our services, even if sales terms are finalized or payment is made outside of bestcoverartists.com.You may be liable to pay a final value fee applicable to that item if you offer or reference your contact information or ask a buyer for their contact information in the context of buying or selling outside of bestcoverartists.com, even if the item does not sell, due to your use of our services for the introduction to a buyer. Bestcoverartists may collect sales taxes from you using the payment method on file under the terms of the billing agreement or any other means accessible to us in any country where Bestcoverartists is required to collect sales taxes on sales you make using our services. We may showcase third-party advertisements (such as links and references) or other content in any part of our platform, in our sole discretion and without permission from, or payment, fee reduction, or other credit to, sellers.

5. Copyright infringement

We do all we can to ensure that listed items and content on our site do not infringe upon the copyright, trademark, or certain other intellectual property rights of third parties. Bestcoverartists respects the intellectual property of others. please email us if you believe that your intellectual property rights are being infringed.

6. Disclaimer of warranties/limitation of liability

We make every effort to maintain our services safe, secure, and functioning, but we cannot guarantee that they will be available at all times. Bid updates and other notification features on bestcoverartists.com may not be available in real time. Such features are subject to delays that are beyond Bestcoverartists’ control.

You agree that you are making use of our Services at your own risk. As a result, we disclaim all explicit and implied warranties, terms, and conditions, including, but not limited to, implied warranties of merchantability, fitness for a specific purpose, and non-infringement, to the extent permissible by applicable law.

In addition, to the extent permitted by applicable law, in no event will Bestcoverartists (including our parent, affiliates, and subsidiaries, as well as their officers, directors, agencies, and staff members) be liable to you or or any third party for any consequential loss or damages (including, but not limited to, monetary loss or reputation, earnings, other intangible losses, or any specific, indirect, or consequential damages), and all such damages or losses have been expressly excluded by this agreement whether or not they are caused by our negligence. Without limiting the foregoing, we (including our parent, subsidiaries, and affiliates, but also their officers, directors, agents, and employees) are not liable, and you agree not to hold us liable, for any damages or losses (including, but not limited to, loss of money, goodwill or reputation, profits, other intangible losses, or any special, indirect, or consequential damages) resulting directly or indirectly from:

• the material you supply through our services (directly or indirectly);
• your use of our Services, or your incapacity to utilize them;
• pricing, format, or other guidance provided by Bestcoverartists;
• delays or disruptions in our services;
• viruses or other harmful programs obtained by accessing or linking to our services;
• any form of problems, bugs, mistakes, or inaccuracies in our services;
• use of any Bestcoverartists service potentially cause damage to your hardware device;
• third-party content, acts, or inactions, such as items listed through our services or the destruction of purportedly counterfeit merchandise;
• a suspension or other action taken in relation to your account, or a violation of the above rule on misusing Bestcoverartists;
• the length or appearance of your listings in search results, as stated in the listing conditions section above; or
• As a result of changes to this user agreement or our rules, you may need to adapt your practices, content, or conduct, or you may lose or be unable to do business.

Because warranty disclaimers and damage exclusions are restricted in some jurisdictions, such disclaimers and exclusions may not apply to you.

7. Your account

To utilize certain Bestcoverartists services, you may need your own Bestcoverartists account, and you may be required to be logged in and have a valid payment method linked with it. We may charge any other valid payment method linked with your account if there is a problem billing your selected payment method. You agree to take responsibility for any activities that occur under your account or password, including maintaining the security of your account and password and restricting access to your account. If you are under 18, you may use the Bestcoverartists services only with involvement of a parent or guardian.
